If you’ve ever delayed a small home improvement project because the "permitting headache" seemed bigger than the job itself, I have some great news for you. Governor DeSantis just signed House Bill 803 into law, and it’s a massive win for property rights here in South Florida. 


Effective July 1, 2026, this law cuts through the red tape for minor projects, making it faster and cheaper to keep your home in top shape. As your go-to Broward real estate experts, we want to make sure you know exactly how to use this new freedom to boost your property value. 

1. The $7,500 "Permit-Free" Threshold - The big headline is the new exemption for small-scale work. Local governments are now prohibited from requiring a building permit for work on a single-family home if the total value is $7,500 or less.

2. The "Big Five" Still Need Permits 

What’s Included: Think of those "quality of life" upgrades—installing a new fence, building a small deck, or minor non-structural repairs. Previously, these could take weeks of waiting at city hall; now, you can get straight to work.

  • The "Flood" Exception: Since we’re in Broward, there is a catch. This exemption does not apply to properties in designated flood hazard areas. In many parts of Fort Lauderdale and Hollywood, you’ll still want to verify your flood zone before you start.

While HB 803 gives us more freedom with cosmetics, it isn't a "free-for-all" for major systems. To keep homes safe (and insurable), you still need a permit for: 
Electrical, Plumbing, Mechanical (HVAC), Gas Lines, Structural Changes (like moving load-bearing walls.


3. Fast-Tracking Hurricane Protection

If you’re looking to add removable storm protection that meets state standards, you no longer have to pay a permit fee or wait for an inspector to tell you it’s okay to protect your house.

4. No More "Permit Purgatory" - For larger projects (under $15,000) that still require a permit, the law now forces cities to move at the speed of business.

  • The 5-Day Rule: Local governments now have a 5-day response timeframe to review applications for these smaller projects.

  • Private Inspectors: If the city is moving too slowly, the law allows you to hire a licensed Private Provider to handle inspections, and the city is required to reduce your permit fees accordingly.

FAQ: HB 803 and Your ROI

Q: Can I break a $15,000 project into two $7,500 halves to skip the permit?

A: Nice try! The law explicitly says projects cannot be divided to evade permitting. Doing this can lead to major fines and "unpermitted work" headaches when you eventually try to sell.

Q: Does this mean I can build a shed without a permit?

A: If it’s non-habitable, non-structural, and under $7,500, yes—as long as you aren't in a flood zone. Just remember, you still have to follow your local setback rules (how close you can build to the property line).

Q: How does this help me when I sell my house?

A: One of the biggest deal-killers in Broward is finding unpermitted work during a title search. By raising this threshold, many minor improvements are now officially "legal," which clears the path for a smoother closing.
